Terms of Service
Last updated: 9 September 2026
These terms describe the general basis on which Boaz Build, based in Gujarat, India, provides website design, branding, content, automation and custom software services. Read them together with the written quotation, proposal or service agreement for your project.
An enquiry or request for a quotation does not by itself create a paid order. Work and payment obligations begin as set out in the quotation or agreement you accept. Project-specific written terms take priority if they differ from these general terms, subject to applicable law. Nothing here removes rights that cannot legally be excluded.
1. Scope and quotations
Your written quotation identifies the deliverables, inclusions, exclusions, price, currency and relevant assumptions. Website prices are starting indications unless expressly described as a fixed offer. Any applicable taxes, third-party charges, subscriptions and renewal costs should be identified in the quotation before you accept it.
Custom applications, technical tools, integrations and additional functionality are included only when expressly agreed. Illustrative images and concept interfaces on this website show possible approaches; they are not a promise that every feature shown is included in your project.
2. Delivery and client inputs
We agree the project schedule after reviewing scope, required content, access and approvals. There is no single delivery period that applies to every service. The written quotation confirms the timeline and any milestones.
You are responsible for supplying accurate content, required access and timely feedback. Changes in scope, delayed inputs, third-party dependencies or circumstances outside either party’s reasonable control may affect delivery. We will communicate material changes and agree a revised plan rather than treat a website estimate as a guaranteed deadline.
3. Prices and payment
Deposit requirements, payment milestones, due dates and accepted payment methods are agreed for each project. We do not impose a standard deposit percentage or late-payment charge through this page.
Additional work or costs require agreement before they are incurred. If payment is overdue, we will contact you to resolve it; any suspension or withholding of final handover must follow the project agreement and applicable law.
4. Feedback, revisions and changes
The quotation sets out included revision rounds and the review process. A revision refines an agreed deliverable; a new feature, a changed brief or a new direction may be additional work. We will explain any effect on price or timing and obtain agreement before proceeding with the change.
Please review drafts and final deliverables carefully, including text, contact details, translations and business-specific information. Report errors or concerns promptly. Approval does not remove remedies available under applicable law.
5. Ownership and licences
After full payment, ownership of the bespoke final deliverables identified for transfer in your quotation passes to you to the extent that Boaz Build owns and can transfer those rights. The quotation should state which editable or source files are included.
Pre-existing tools, reusable code, fonts, stock assets, open-source components and third-party software remain subject to their own ownership and licence terms. We cannot transfer rights we do not own. Any restrictions or ongoing licences relevant to the agreed deliverables should be explained during scope review.
You retain ownership of materials you supply and authorise us to use them for the project. You are responsible for having the necessary rights and permissions. Permission to publish confidential work or identify you in a case study should be agreed separately.
6. Third-party services and ongoing support
Hosting, domains, business email, payment services, messaging platforms and other external tools may have separate fees, renewal dates and terms. Account ownership, billing responsibilities, access and handover arrangements should be stated in the project agreement.
Maintenance, hosting management, backups, content changes and support after delivery are included only to the extent agreed. External platforms can change their features, prices or access requirements; any resulting project changes will be discussed with you.
7. Cancellation, pauses and refunds
If either party needs to pause or cancel, please give written notice as soon as possible. We will review completed work, agreed milestones and any non-cancellable third-party commitments, and confirm the handover and financial position in writing.
Any amount payable or refundable is determined by the accepted project agreement, work properly performed and applicable law. These terms do not create a blanket “no refunds” rule. Any mandatory cancellation or consumer rights continue to apply.
8. Results, technical review and responsibility
We do not guarantee a particular search ranking, sales level, lead volume, advertising result, tender award or third-party platform approval. Outcomes depend on factors beyond the delivered work.
Software calculations, selection outputs, translations and quotation documents must be reviewed against the agreed validation requirements before operational use. Technical tools support qualified professional judgement; they do not replace required engineering, regulatory or commercial checks. This does not remove our responsibility to deliver the agreed scope with reasonable care and skill.
9. Liability and resolving concerns
Please contact us promptly if the work does not meet the agreed scope so we can investigate and discuss an appropriate correction or remedy. Responsibility for loss will be assessed under the project agreement and applicable law. Nothing in these terms excludes liability or remedies that cannot lawfully be excluded.
We encourage both parties to attempt a practical resolution in writing before escalating a dispute. Any agreed governing-law or dispute-resolution provision belongs in the project contract and cannot override mandatory rights or access to a competent authority or court.
10. Privacy, updates and contact
Our Privacy Policy explains how we handle enquiry and project contact information. Our Cookie Policy covers browser technologies and consent controls.
Changes to this page are dated above and do not automatically rewrite an already accepted project contract. Amendments to an existing project should be agreed in writing.
